FertilityFriend.com License Agreement

PLEASE READ THE FOLLOWING LICENSE AGREEMENT CAREFULLY BEFORE USING FERTILITYFRIEND.COM.
Fertility Friend and FertilityFriend.com are owned by Tamtris Web Services Inc, a company serving people worldwide who are trying to conceive or are pregnant.
This Agreement is your entire agreement with Tamtris Web Services Inc. and governs your use of the FertilityFriend.com service. By using the FertilityFriend.com service, you indicate your acceptance of the following license agreement. If you do not agree to the terms of this agreement, promptly stop using FertilityFriend.com.
You must be at least 18 years of age and above the age of legal majority in your country to use FertilityFriend.com.
Any answer or information given by this service does not constitute medical practice or advice, nor is it intended to replace the necessity of consultation with a physician. Always consult your personal physician for definitive answers to your medical questions. You agree that we will incur no legal or moral liabilities to you or anyone else for your use of this service. We explicitly warn against and prohibit the use of FertilityFriend.com as a contraception tool or for pregnancy avoidance. FertilityFriend.com has been designed only to provide tools for people interested in getting pregnant. FertilityFriend.com cannot be used for scheduling or planning medical procedures, medication, or supplements usage. Always consult your health care provider before taking such decisions.

Your account is personal and cannot be shared. You must keep your account password secret. Information stored in your account is confidential. You may not sub-license, or charge others to use or access our service.
Tamtris Web Services Inc. and FertilityFriend.com accept no responsibility for the information or advice posted in any part of the FertilityFriend.com website, the FertilityFriend.com Circles, the FertilityFriend.com's Home Pages or any other user generated document. Any abuse of the website will lead to the termination of your account at our sole discretion.
Your access and use of FertilityFriend.com Circles (message boards or chat rooms) is a privilege not a right. You are required to abide by the terms and conditions of FertilityFriend.com Circles' Charter, as it presently exists, or as it may change form time to time. The FertilityFriend.com Charter has been created to ensure that users of the Circles can participate in a safe, comfortable and non-commercial environment. In particular, the posting of medical or self-medication advice, commercial activity and abusive language in the Circles are prohibited. Your access to the FertilityFriend.com Circles may be discontinued at the sole discretion of FertilityFriend.com at any time, and will be discontinued for any violation of the terms and conditions of the FertilityFriend.com Charter. Applicable Laws
This agreement shall be governed by and construed according to the laws of the Province of Ontario, Canada.
If any part of this Agreement is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
Disclaimer
You agree to defend, indemnify and hold harmless Tamtris Web Services Inc., FertilityFriend.com and its directors, officers, agents and employees from all liabilities, claims and expenses, including legal fees, which arise from a breach of this Agreement for which you are responsible or by your use of FertilityFriend.com.
To the maximum extent permitted by applicable law, Tamtris Web Services Inc., FertilityFriend.com and its directors, officers, agents and employees disclaim all warranties, either express or implied including but not limited to implied warranties of merchantability, fitness for a particular purpose and non infringement. Tamtris Web Services Inc., FertilityFriend.com and its directors, officers, agents and employees shall not be liable for any damages whatsoever, including direct, indirect, lost profits or information, business interruption, or other pecuniary loss, even if they or anyone of them have been advised of the possibility of such damage or loss.
Termination and Cancellation
Either you or Tamtris Web Services Inc. may terminate or cancel your membership at any time, with or without cause. You understand and agree that the cancellation of your account is your sole right and remedy with respect to any dispute with Tamtris Web Services Inc. or FertilityFriend.com. This includes, but is not limited to, any dispute related to, or arising out of: (1) any term of this Agreement; (2) Tamtris Web Services Inc. or FertilityFriend.com's enforcement or application of this Agreement; (3) the content available on FertilityFriend.com's web site; (4) your ability to access and/or use Fertility Friend On-Line including the revocation of your access to the Circles or any other part of the site; or (5) the amount or type of fees, surcharges, applicable taxes, billing methods, or any change to the fees, applicable taxes, surcharges or billing methods.
